1. About These Terms

These Terms & Conditions apply to all purchases made through The Brick Hut website.

By accessing our website and placing an order, you agree to be bound by these Terms & Conditions together with our Privacy Policy.

These Terms may be updated from time to time to reflect changes in our business, legal requirements or the services we provide. The version published on our website at the time your order is placed will apply.

All contracts are formed in English and are governed by the laws of England and Wales.

Nothing within these Terms affects your statutory rights.

We process personal information in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and other applicable privacy legislation.

4. Products & Availability

All products and services are offered subject to availability.

Images shown on our website are for illustration purposes only. Actual products, packaging and colours may vary slightly.

Where products become unavailable after an order has been placed, we reserve the right to:

• cancel the order and issue a full refund; or

• where appropriate, offer a suitable alternative product. We will contact you before dispatch wherever reasonably possible.

We reserve the right to limit quantities purchased by any individual or household.


5. How Our Contract Is Formed

When you place an order:

• you will receive an automated acknowledgement confirming we have received your order;

• this acknowledgement does not constitute acceptance of your order;

• a legally binding contract is formed only when your order is dispatched and you receive confirmation that it has been shipped.

We reserve the right to refuse or cancel any order before dispatch including, but not limited to:

• pricing errors;

• stock shortages;

• suspected fraudulent activity;

• suspected breach of our Anti-Scalping Policy.


6. Prices & Promotions

All prices are shown in Pounds Sterling (£) and include VAT where applicable.

Delivery charges are displayed separately during checkout.

Promotional offers, voucher codes and discounts:

• are subject to availability;

• cannot normally be combined unless expressly stated;

• may be withdrawn or amended without notice.

If an obvious pricing error occurs, we reserve the right to cancel the order and refund any payment made.


7. Payment

We accept payment using the payment methods displayed during checkout, including major debit and credit cards, PayPal and other supported payment providers.

Payment must be received in full before goods are dispatched.


8. Order Amendments & Cancellation Before Dispatch

Customers may request to amend or cancel an order before it has been dispatched.

Where an order has not entered our picking or packing process, we will make every reasonable effort to accommodate the request.

Once an order has been dispatched, it cannot be amended or cancelled and must instead be handled under our Returns Policy and your statutory consumer rights.

Refunds for cancelled orders will be issued using the original payment method.


9. Delivery

We use trusted delivery partners including Royal Mail, Evri, DHL, UPS, Parcelforce and other reputable couriers where appropriate.

Delivery charges are clearly displayed during checkout before payment is taken.

Unless otherwise stated on the relevant product page:

• we aim to dispatch orders within one working day;

• standard UK delivery normally takes between one and two working days following dispatch.

These times are estimates only and are not guaranteed.

Dispatch may take longer during busy periods, product launches, supplier delays, adverse weather, public holidays or circumstances outside our reasonable control.

Risk in the goods passes to you upon delivery to the address provided during checkout.

Ownership of goods remains with The Brick Hut until full payment has been received.

Where parcels are delayed, lost or misrouted, we will work with the delivery company to investigate and resolve the matter.

Our liability for delayed, lost or misrouted deliveries is limited to the value of the goods purchased together with any delivery charge paid.

We shall not be liable for indirect or consequential losses including, but not limited to, loss of earnings, travel expenses, accommodation costs, third-party costs or loss of business arising from delayed delivery except where required by law.


10. Returns, Refunds & Consumer Rights

Nothing in these Terms limits your statutory rights under the Consumer Rights Act 2015 or Consumer Contracts Regulations.

If your goods are faulty, damaged, not as described or otherwise fail to meet your legal rights, you are entitled to an appropriate repair, replacement or refund.

If you simply change your mind, you may exercise your cancellation rights in accordance with the Consumer Contracts Regulations.

Unless we state otherwise, customers are responsible for return postage costs for change-of-mind returns.

Where goods are faulty, damaged or supplied incorrectly, The Brick Hut will cover reasonable return postage costs or provide a prepaid returns label where appropriate.

Returned goods should be securely packaged.

Until returned goods are received by us, they remain the customer’s responsibility.

We recommend using a tracked delivery service.


11. Anti-Scalping Policy

We are committed to ensuring products remain available to genuine customers.

To support this we may:

• limit purchase quantities;

• cancel duplicate or excessive orders;

• cancel orders suspected of commercial resale;

• refuse future orders where our policies are repeatedly circumvented.

For certain high-demand products we may remove shrink wrap, apply identifying marks or otherwise modify external packaging to discourage resale.

These measures do not affect product authenticity or functionality.


12. Trading Card Products

Trading card products including Pokémon, Magic: The Gathering, Disney Lorcana, One Piece, Yu-Gi-Oh!, Union Arena and similar products are sold on the following basis:

• contents are random;

• individual cards cannot be guaranteed;

• pull rates cannot be guaranteed;

• packaging may contain minor cosmetic imperfections;

• opened products cannot be returned unless faulty.

Secondary market values are outside our control and do not form part of any contract.


13. Bulk Lots & Repacked Products

Bulk lots, mystery products and repacked products may contain duplicate items.

No guarantee is made regarding ratios, rarity or contents.

These products are sold as described and are not eligible for return simply because the contents differ from expectations.


14. Personalised Products

We reserve the right to refuse personalisation requests containing:

• offensive material;

• unlawful material;

• copyrighted or trademarked content where permission has not been obtained.

Personalised products cannot normally be cancelled or returned unless faulty.


15. Pre-Orders

Pre-order dates are estimates supplied by manufacturers and distributors.

Release dates may change without notice.

Supplier allocations may also change.

Where we cannot fulfil a pre-order, customers will receive either:

• a full refund; or

• an alternative product where agreed.


16. Liability

Nothing in these Terms excludes liability for:

• death or personal injury caused by negligence;

• fraud;

• any liability which cannot legally be excluded.

Subject to the above, our total liability shall not exceed the total amount paid for the relevant order.

Goods supplied are intended for private domestic use only.


17. Events Beyond Our Control

We shall not be responsible for delays or failures caused by circumstances beyond our reasonable control including:

• supplier delays;

• courier disruption;

• strikes;

• severe weather;

• natural disasters;

• power failures;

• internet outages;

• government restrictions.


18. Business Orders

Customers purchasing on behalf of businesses or organisations confirm they have authority to place the order.

Additional terms may apply to commercial, educational or bulk purchases.


19. Privacy Notice

We collect personal information only where necessary to:

• process orders;

• deliver purchases;

• provide customer support;

• comply with legal obligations;

• improve our website and services.
